Affiliate Programme Terms & Conditions

These Affiliate Programme Terms & Conditions (“Affiliate Terms”) govern participation in the Mind Body Soul Academy Affiliate Programme.

The programme is operated by:

By applying to, joining or participating in the Mind Body Soul Academy Affiliate Programme, you agree to these Affiliate Terms.

1. About the Affiliate Programme

The Mind Body Soul Academy Affiliate Programme allows approved affiliates to earn commission by referring eligible customers to selected Mind Body Soul Academy products, resources, courses, memberships or services using approved affiliate links, referral codes or other tracking methods provided by us.

Participation is subject to approval and is not automatic.

We may accept or decline an application at our discretion where reasonably necessary to protect the Academy, our customers, our intellectual property or the integrity of the programme.

2. Eligibility and Approval

Applicants must:

  • be at least 18 years old;

  • provide accurate and complete application information;

  • have an audience, platform, business or professional activity that is reasonably compatible with the values and work of Mind Body Soul Academy;

  • comply with applicable advertising, consumer-protection, privacy and marketing laws; and

  • promote the Academy honestly, professionally and responsibly.

We particularly welcome applications from practitioners, therapists, coaches, educators, wellbeing professionals, content creators and trusted partners whose audiences may genuinely benefit from our resources and training.

Approval may be withdrawn if an affiliate subsequently acts in a way that is inconsistent with these Affiliate Terms.

3. Affiliate Relationship

Participation in the Affiliate Programme does not create an employment relationship, partnership, joint venture, franchise, agency or representative relationship between you and Mind Body Soul Academy.

Affiliates operate independently and are responsible for their own business activities, expenses, insurance, registrations, tax obligations and legal compliance.

Affiliates do not have authority to make commitments, warranties, guarantees or representations on behalf of Mind Body Soul Academy.

4. Affiliate Links and Tracking

Approved affiliates will be provided with access to affiliate tracking facilities, which may include unique referral links, codes, coupons or other tracking tools.

You are responsible for using the tracking methods supplied or approved by us correctly.

Commission can only be credited where a qualifying referral is successfully attributed to your affiliate account through the applicable tracking system.

Tracking may be affected by matters outside our control, including browser settings, privacy software, cookie restrictions, device changes or customers clearing stored data. We cannot guarantee that every referral will be successfully tracked.

5. Commission Rates and Eligible Products

Commission rates may vary between products, offers, promotions, subscriptions or affiliate arrangements.

The commission rate applicable to an eligible product will be shown in your affiliate account, programme information or other written communication from Mind Body Soul Academy.

Not every Mind Body Soul Academy product or service will necessarily be commissionable.

Unless specifically stated otherwise, participation in the programme does not guarantee recurring commission on subscriptions or repeat purchases.

We may introduce product-specific or affiliate-specific commission rates where appropriate.

6. Qualifying Purchases

Commission is earned only on qualifying purchases that:

  • are successfully completed and paid;

  • are properly attributed to your affiliate account;

  • are not fraudulent, cancelled, refunded, disputed or charged back;

  • are not prohibited self-referrals; and

  • otherwise comply with these Affiliate Terms.

Commission is normally calculated on the eligible purchase value after applicable discounts and excluding amounts that are not commissionable, such as taxes, refunds, chargebacks, shipping or other excluded charges where applicable.

7. Refunds, Chargebacks and Reversals

Where a purchase is subsequently refunded, cancelled, disputed, charged back or identified as fraudulent or otherwise ineligible, any associated affiliate commission may be cancelled, deducted or reversed.

If commission relating to such a transaction has already been paid, we may deduct the corresponding amount from future affiliate earnings where legally permitted.

8. Affiliate Payments

Affiliate earnings and payment information will be available through the affiliate system where applicable.

Payment schedules, minimum payout thresholds, available payment methods and any other payout conditions will be communicated through the affiliate dashboard or programme information.

Affiliates are responsible for providing accurate and current payment details.

Any tax, reporting, banking, payment-processing or currency-conversion obligations applicable to an affiliate remain the affiliate’s responsibility unless applicable law provides otherwise.

9. Advertising Disclosure

Affiliates must clearly disclose their commercial relationship with Mind Body Soul Academy whenever promoting products through an affiliate link, referral code or other commission-generating arrangement.

The disclosure must be clear, prominent and understandable to the audience and must comply with the advertising and consumer-protection rules applicable in the country or platform where the promotion appears.

The disclosure should make it clear that you may receive a commission if someone purchases through your link or code.

A disclosure must not be hidden solely within terms and conditions, a profile page, hashtags that are difficult to understand, or another location that consumers are unlikely to notice.

10. Honest and Responsible Promotion

Affiliates must promote Mind Body Soul Academy honestly and must not:

  • make false, misleading or unsubstantiated claims;

  • misrepresent the features, price, availability or expected results of a product;

  • guarantee results or outcomes;

  • suggest that a product can diagnose, treat, prevent or cure a medical or psychological condition unless such a claim has been expressly authorised and is legally permissible;

  • present personal-development, wellbeing or practitioner resources as substitutes for appropriate medical, psychological or other regulated professional care;

  • use fabricated reviews, testimonials or endorsements;

  • impersonate Mind Body Soul Academy, Kimberley Stapleton or any member of our team;

  • falsely suggest an endorsement, partnership or professional status that does not exist; or

  • use fear, pressure, deception or misleading scarcity to encourage a purchase.

Affiliates should describe their genuine experience or opinion and must not make representations that go beyond information provided or authorised by Mind Body Soul Academy.

11. Email, Messaging and Direct Marketing

Affiliates must not send unsolicited commercial emails, direct messages, SMS messages or other electronic marketing communications in connection with Mind Body Soul Academy.

Any email or direct marketing undertaken by an affiliate must comply with applicable privacy, electronic-communications and direct-marketing laws and must include any consent, identification and unsubscribe mechanisms required by law.

Affiliates may not represent that a mailing list or contact database belongs to, is sponsored by, or has been approved by Mind Body Soul Academy unless we have expressly agreed this in writing.

12. Paid Advertising

Unless expressly authorised by us in writing, affiliates must not:

  • bid on “Mind Body Soul Academy”, “Kimberley Stapleton” or confusingly similar branded search terms;

  • purchase advertising that appears to be an official Mind Body Soul Academy advertisement;

  • use our brand name in misleading advertisement URLs, display URLs or account names;

  • register domains, social-media accounts or profiles that could reasonably be mistaken for an official Academy property; or

  • run paid advertisements that direct consumers in a misleading way through an affiliate link.

Affiliates may promote their own genuine content through paid advertising provided that the advertising complies with these Terms and does not create confusion about who is operating the advertisement.

13. Coupons, Discounts and Promotional Offers

Affiliates may only advertise discounts, coupon codes or promotional offers that have been supplied or expressly authorised by Mind Body Soul Academy.

Affiliates must not:

  • invent discount codes;

  • advertise expired offers;

  • publish misleading discount claims;

  • imply that a standard price is a discounted price; or

  • list unauthorised codes on coupon or voucher websites.

Any expiry date, eligibility condition or other restriction attached to an offer must be communicated accurately.

14. Self-Referrals and Manipulation

Affiliate links and codes are intended to generate genuine new customer referrals.

Unless we expressly permit otherwise, affiliates may not earn commission on their own purchases.

The following are prohibited:

  • creating multiple accounts to obtain affiliate commission;

  • referring yourself through another identity or account;

  • cookie stuffing;

  • forced redirects;

  • artificial clicks or transactions;

  • misleading tracking practices;

  • fraudulent orders;

  • manipulating attribution; or

  • any other attempt to generate commission that does not represent a genuine customer referral.

Commission associated with such activity may be withheld or reversed and the affiliate account may be terminated.

15. Intellectual Property and Brand Use

Mind Body Soul Academy retains all rights in its names, logos, trademarks, course materials, resources, graphics, photographs, copy, videos and other intellectual property.

Approved affiliates receive a limited, revocable, non-exclusive and non-transferable permission to use promotional assets supplied or approved by us solely for the purpose of participating in the Affiliate Programme.

Affiliates may not:

  • modify our logos in a misleading or damaging way;

  • copy, reproduce, resell or distribute paid Academy resources;

  • present Academy materials as their own;

  • create derivative products using our intellectual property without permission; or

  • use our branding in a way that implies ownership of or official representation of Mind Body Soul Academy.

Permission to use our materials ends when participation in the Affiliate Programme ends.

16. Use of Artificial Intelligence and Automated Content

Affiliates may use legitimate tools to assist with content creation, but remain fully responsible for everything they publish.

AI-generated or automated promotional content must not contain fabricated testimonials, false claims, inaccurate product information, misleading representations or content that infringes another person’s rights.

Affiliates should review promotional content for accuracy before publication.

17. Customer Data and Privacy

Participation in the Affiliate Programme does not give affiliates ownership of or general access to Mind Body Soul Academy customer data.

Affiliates must not attempt to collect, extract, identify, sell, share or misuse customer information obtained through the programme.

Any personal information an affiliate independently collects must be handled in accordance with applicable data-protection and privacy laws.

Our own handling of personal data is governed by the Mind Body Soul Academy Privacy Policy.

18. Monitoring and Programme Integrity

We may monitor affiliate activity where reasonably necessary to:

  • verify commission eligibility;

  • protect customers;

  • investigate suspicious activity;

  • ensure compliance with these Affiliate Terms;

  • protect our intellectual property; and

  • maintain the reputation and integrity of the programme.

We may ask an affiliate to amend or remove promotional content that materially breaches these Terms.

19. Suspension or Termination

Either party may end participation in the Affiliate Programme.

We may suspend or terminate an affiliate account where we reasonably believe there has been:

  • a breach of these Affiliate Terms;

  • fraudulent or manipulative activity;

  • misleading advertising;

  • misuse of customer data;

  • misuse of our intellectual property;

  • unlawful promotional activity;

  • conduct likely to materially damage Mind Body Soul Academy or its customers; or

  • another serious abuse of the programme.

Termination does not remove any obligations or liabilities that arose before termination.

Valid commission earned before termination may remain payable subject to these Terms, although commission connected with prohibited, fraudulent, refunded or otherwise ineligible activity may be withheld or reversed.

20. Changes to the Programme

We may update the Affiliate Programme, including eligible products, commission structures, promotional materials, tracking arrangements and these Affiliate Terms.

Where a change materially affects existing affiliates, we will make reasonable efforts to provide appropriate notice.

Continued participation after updated Terms take effect constitutes acceptance of the revised Terms.

21. Availability of the Programme

We may modify, suspend or discontinue all or part of the Affiliate Programme where reasonably necessary.

Nothing in these Terms guarantees that the programme, a particular product or a particular commission arrangement will remain available indefinitely.

22. Limitation of Liability

To the fullest extent permitted by applicable law, Mind Body Soul Academy will not be liable for indirect or consequential losses arising from participation in the Affiliate Programme, including loss arising from tracking failures, platform outages or expected future commission.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

23. Governing Law

These Affiliate Terms are governed by the laws of Malta.

Any dispute relating to the Affiliate Programme will be subject to the jurisdiction of the courts of Malta, except where mandatory law requires otherwise.
