These Terms of Service govern your use of the Mind Body Soul Academy website and your purchase, download or use of our digital resources, courses, training programmes, memberships, practitioner resources, templates and related services (collectively, the “Services”).

By purchasing or using our Services, you agree to these Terms together with our Privacy Policy, Refund Policy and any product-specific licence or disclaimer supplied with your purchase.

Nothing in these Terms limits any mandatory consumer rights that apply to you under Maltese or European Union law. Malta’s Electronic Commerce Act governs electronic transactions and online commerce alongside applicable EU consumer legislation.

1. About Mind Body Soul Academy

Mind Body Soul Academy provides educational, professional-development and personal-development resources for individuals and practitioners, including therapists, counsellors, coaches and holistic practitioners.

Our Services may include digital downloads, editable resources, practitioner tools, scripts, audio resources, courses, training programmes, memberships and community access.

You must be at least 18 years old to purchase our Services unless a particular programme expressly provides otherwise.

2. Educational, Holistic and Professional Disclaimer

Mind Body Soul Academy resources may explore subjects including somatic awareness, nervous-system education, hypnotherapy, NLP, coaching, Reiki, energy work, meditation, holistic wellbeing and related personal-development approaches.

Our educational products and resources are not a substitute for medical, psychiatric, psychological, legal or other appropriately qualified professional advice, diagnosis or treatment.

Nothing provided through Mind Body Soul Academy should be interpreted as a guarantee that a particular physical, psychological, emotional, financial, professional or personal outcome will occur.

If you are a practitioner, you remain responsible for:

• working within your own qualifications, competence and professional scope;
• deciding whether a resource or technique is appropriate for an individual client;
• obtaining any appropriate client consent;
• maintaining appropriate professional insurance where required; and
• complying with the laws, regulations and professional standards applicable to your own practice.

If a client or participant experiences significant distress or has a medical or mental-health concern, appropriate qualified professional support should be sought.

3. Intellectual Property

Unless expressly stated otherwise, all original course materials, written content, worksheets, scripts, graphics, videos, audio, training materials, templates and downloadable resources supplied by Mind Body Soul Academy remain protected by applicable copyright and intellectual-property law.

Purchasing a product does not transfer copyright or ownership of the original material.

Your rights depend upon the licence stated on the particular product.

A. Editable Practitioner Resources

Where a product is expressly sold with a Single-Practitioner Professional Use Licence, you may normally:

• add your own practice branding, logo and contact information;
• make reasonable minor wording or design adjustments where the product is editable;
• use the finished resource with your own clients;
• print or digitally provide the finished resource to your own clients;
• use it within your own sessions, programmes or workshops; and
• where expressly permitted by the product licence, use the finished resource as a free lead-generation resource for your own practice.

Unless a product expressly provides otherwise, you may not:

• sell, share or redistribute the editable template or original source file;
• share a Canva template link with another practitioner or business;
• resell the product as PLR, MRR or an editable commercial template;
• transfer your licence to another practitioner or organisation;
• claim copyright ownership of the original Mind Body Soul Academy material; or
• upload or publish the original resource for resale through third-party marketplaces.

B. Practitioner Scripts

Where a practitioner script carries a Single-Practitioner Professional Use Licence, the purchasing practitioner may use the script within their own professional practice in accordance with the licence supplied with that product.

Where expressly permitted, this may include reading the script during private client sessions and recording the script in the purchasing practitioner’s own voice for private use with their own clients.

The original written script itself may not be resold, shared, sublicensed, republished, distributed to other practitioners or presented as the purchaser’s own original copyrighted work.

C. Courses, Training, Audio and Video

Unless expressly stated otherwise, course videos, training recordings, proprietary audio, manuals and educational materials are licensed to the purchaser for their own learning and use.

They may not be copied, resold, uploaded, shared publicly, distributed to third parties or made available through another membership, course or training platform without written permission.

4. Accounts and Access

Where an account is created for you, you are responsible for keeping your login information secure.

You may not share paid account credentials or deliberately allow another person or organisation to access resources licensed only to you.

We may suspend access where there is reasonable evidence of fraud, unauthorised sharing, intellectual-property infringement or material breach of these Terms.

Where reasonably possible, we will contact you before permanently terminating access.

5. Digital Delivery

Digital products are normally delivered electronically through the Mind Body Soul Academy website, customer account, email or another delivery method stated at checkout.

You are responsible for providing a valid email address and for downloading and safely storing downloadable resources where appropriate.

If you have genuine difficulty accessing a purchased resource, please contact support@mindbodysoulacademy.org.

6. Digital Purchases and Right of Withdrawal

Where you purchase as a consumer, statutory consumer rights may apply.

EU rules ordinarily provide a 14-day withdrawal period for many online contracts. However, different rules apply where digital content is supplied immediately.

Where we provide immediate access to downloadable or streaming digital content before the withdrawal period expires, we may ask you at checkout to:

1. expressly request or consent to immediate supply of the digital content; and
2. acknowledge that once supply or downloading begins you may lose your statutory right of withdrawal.

This reflects the requirements applying to immediately supplied digital content under EU consumer law.

Nothing in our Refund Policy or these Terms removes rights you may have where digital content is faulty, materially not as described or otherwise subject to mandatory statutory remedies.

7. Courses, Services and Promotional Guarantees

Some programmes or products may carry an additional voluntary money-back guarantee.

Where such a guarantee is offered, its duration and conditions will be clearly stated on the relevant product or checkout page at the time of purchase.

A voluntary guarantee operates in addition to, and does not replace or restrict, any mandatory statutory rights that apply.

Where a guarantee reasonably requires evidence that course material or exercises have been completed, those requirements will be clearly disclosed before purchase.

8. Memberships and Recurring Payments

Where you purchase a subscription or recurring membership, you authorise the payment provider to charge the agreed recurring amount at the interval disclosed at checkout until the subscription is cancelled.

You may cancel future renewals using the cancellation method made available through your account or by contacting us.

Cancellation prevents future billing but does not normally create a retrospective refund for a billing period that has already begun, except where required by law or where a specific guarantee applies.

Any minimum commitment or special cancellation terms applying to a particular membership will be clearly disclosed before purchase.

9. Community Conduct

Some programmes may include access to private communities, discussion spaces or third-party groups.

Members must behave respectfully and must not engage in harassment, threatening behaviour, discrimination, spam, unauthorised commercial solicitation or unlawful activity.

We may restrict or remove community access where reasonably necessary to protect other members, our staff or the integrity of the community.

Termination of community access does not affect statutory rights relating to a purchased product or service.

10. Prices and Payment

Prices are displayed in the currency shown at checkout.

Any applicable taxes will be handled according to the information presented during checkout and applicable tax rules.

Payment processing may be provided by third-party payment providers such as Stripe and other authorised payment services. Those providers may process payment information in accordance with their own terms and privacy policies.

We do not normally receive or store your complete payment-card details.

11. Chargebacks and Payment Disputes

If you believe a payment has been taken incorrectly or you have a problem with a purchase, please contact us first at support@mindbodysoulacademy.org so that we have an opportunity to investigate and resolve the matter.

Nothing in these Terms prevents you from exercising legitimate rights available through your card issuer, payment provider or applicable consumer law.

We reserve the right to contest chargebacks that we reasonably believe are incorrect, fraudulent or inconsistent with the transaction records and evidence available to us.

12. Results and Testimonials

Individual experiences vary.

Testimonials, case studies, examples and client experiences describe individual experiences and should not be interpreted as promises or guarantees that you will achieve identical results.

Your results may depend upon many circumstances outside our control, including your own actions, experience, qualifications and personal circumstances.

13. Third-Party Services and Links

Our website and products may contain links to third-party websites, platforms or software, including services such as Canva, payment processors and other technology providers.

We do not control those third-party services and are not responsible for their availability, security, content or independent terms.

Your use of third-party services may be subject to the provider’s own terms and privacy policy.

14. Availability and Changes to Services

We aim to maintain reasonable availability of our website and digital services but cannot guarantee uninterrupted access.

Temporary interruptions may occur because of maintenance, hosting failures, third-party services, internet outages or circumstances beyond our reasonable control.

We may update or improve our website, courses and resources from time to time, provided this does not unlawfully remove rights associated with an existing purchase.

15. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

Subject to those mandatory rights, Mind Body Soul Academy will not be responsible for indirect or consequential losses arising from circumstances that were not reasonably foreseeable or were outside our reasonable control.

Practitioners using our resources within their own independent businesses remain responsible for their own professional decisions, services, clients and regulatory obligations.

16. Privacy and Data Protection

Personal information is processed in accordance with our Privacy Policy and applicable data-protection legislation, including the General Data Protection Regulation (GDPR).

Our Privacy Policy explains what information we collect, why we process it, the services we use and your data-protection rights. EU data subjects have rights including access, rectification and, in appropriate circumstances, erasure and other GDPR rights.

17. Changes to These Terms

We may revise these Terms where necessary to reflect changes to our Services, business operations or applicable law.

The version applying to your purchase will normally be the version in force when the relevant transaction was completed, unless a later change is required by law.

18. Governing Law

These Terms are governed by the laws of Malta.

If you are purchasing as a consumer in another country, this choice of law does not deprive you of any mandatory consumer protections that apply to you under the laws that cannot contractually be excluded.

Nothing in these Terms is intended to prevent a consumer from exercising statutory rights relating to jurisdiction or dispute resolution that apply under Maltese or European Union law.
